Use claim construction when you need more than a plain reading of the claims. This workflow helps you identify important terms, gather supporting evidence, draft working constructions, compare different construction sets, and prepare reviewed constructions for downstream work.

Open claim construction for the target patent
From the target patent navigation, open Claims. Use this page when you want to:
generate candidate constructions with &AI
add constructions manually
work from selected claim text
review evidence supporting or challenging a definition
export reviewed constructions for later use
Claim construction is about defining terms. If your goal is to rewrite or restructure claim text, use the claim-editing workflow instead.
Start with the active construction set
Claim construction is now organized around construction sets for the patent.
Use the active set when you want to keep one working interpretation together, then create another set when you need to compare alternate positions or duplicate an existing set before editing it further.
This is especially useful when:
different arguments need separate working constructions
you want to preserve an earlier version before making larger edits
opposing or alternate definitions need to be reviewed side by side
Those sets also flow into charting. When you create a new chart or update an existing one, &AI can let you choose which claim construction set the chart should use instead of assuming the active set. Use that selector when the chart should follow an alternate construction theory.
Generate constructions with the right scope
Use the main Construe action when you want &AI to draft constructions for terms that likely need attention.
The current generation flow supports:
default runs focused on independent claims only, which keeps the first pass tighter and easier to review
additional context to steer the generation
page-level options that affect how much evidence &AI should consider
By default, generation starts with independent claims only and a bounded term list so the first pass stays manageable. Generation is the starting point, not the final answer. After the run completes, review the resulting terms, definitions, and evidence before treating the set as ready.
Add terms directly from claim text
You do not need to rely only on a broad generation run.
When you spot a term while reading the claims, select the text and use the inline construe action to add that term directly. This is useful when:
only one or two phrases need construction
you want to bypass a larger run
you already know the disputed term and want to jump straight into review
Review the definition and evidence together
Each construction card is meant to be reviewed like a working draft. Use the card to inspect:
the term being construed
the proposed definition
linked intrinsic or extrinsic evidence
review state such as approved, rejected, or archived
The current workflow also supports richer evidence review so you can look not only at support for a definition, but at evidence that cuts against it. That is useful when you need to pressure-test a proposed construction before adopting it.
Refresh evidence when the definition changes
If you materially change the definition for a term, review the evidence again.
The current workflow is designed so evidence can be refreshed for the updated definition instead of forcing you to start the entire page over. Use that pattern when:
the term definition changes direction
opposing-counsel language needs to be tested
you duplicated a set and are now taking the term in a different direction
Duplicate, compare, and switch sets
When you need alternate construction strategies, duplicate an existing set instead of overwriting it.
That lets you preserve the earlier work while testing:
a narrower definition
a broader definition
an alternate argument structure
different evidence selections
Switch between sets when you want to compare how the same patent reads under different construction theories.
Export reviewed constructions
Once a construction set is in good shape, export it for downstream use.
Export is the right step after you have:
reviewed the key terms
confirmed the evidence state
cleaned up terms that should be rejected or archived
chosen the set you want to carry forward
If export fails or a loading state appears stuck after analyze-evidence work, refresh the page and confirm the analysis run has finished before retrying.
Recommended review pattern
A practical way to use claim construction is:
Start from the active set or duplicate a set if you need an alternate position.
Generate or add the terms that matter.
Review each definition with its supporting and contrary evidence.
Refresh evidence when the definition changes materially.
Approve, archive, or reject constructions as the set stabilizes.
Export the set you want to use in charts, drafts, or broader patent analysis.
